These terms apply to orders placed on this website with The Heavy Tree Cafe & Bar ("we", "us"), trading from 77 Fore Street, Heavitree, Exeter EX1 2RN, United Kingdom. The business is operated by The Heavy Tree. Contact us on 01392 660857 or admin@heavytree.co.uk.

Please read these terms before ordering. By placing an order you agree to them. They don't affect your statutory rights.

1. Your account

  • You need an account to order. Keep your password private — you're responsible for orders placed from your account.
  • You must give accurate contact and delivery details so we can deliver your order and reach you about it.

2. Menu, prices and allergens

  • Prices are in pounds sterling (GBP) and include VAT where applicable. Delivery fees and minimum order values depend on your delivery area and are shown before you pay.
  • Some dishes are only served at certain times (for example breakfast until 12:30, and our Indian menu on Friday and Saturday evenings, 5pm–9pm) and items can sell out. The website only lets you order what we can make now.
  • Photos are illustrative; dishes are freshly prepared and may look different.
  • Allergies: our kitchen handles all 14 major allergens (including gluten, nuts, milk, egg, sesame and mustard). We can't guarantee any dish is free from traces. If you have an allergy or intolerance, call us before ordering on 01392 660857.

3. Placing an order and payment

  • When you check out we confirm the price, delivery fee and delivery area, then take payment securely through our payment provider, Stripe. We never see or store your full card details.
  • Your order is accepted when your payment is confirmed and you see your order confirmation. If payment isn't completed within 30 minutes, the order is cancelled automatically and nothing is charged.
  • We may refuse or cancel an order — for example if an item becomes unavailable, your address is outside our delivery area, or the kitchen has to close unexpectedly. If we cancel an order you've paid for, we refund you in full.

4. Delivery

  • We deliver to addresses inside our delivery areas, using our own team. Delivery times shown are estimates, not guarantees.
  • Please make sure someone is available to receive the order and that your phone is reachable. If we can't deliver because no one is available or the address is wrong, we may not be able to offer a refund.

6. Our responsibility to you

  • If we fail to meet these terms we're responsible for loss or damage you suffer that is a foreseeable result of our failure, but not for losses that aren't foreseeable.
  • We don't exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your rights under the Consumer Rights Act 2015.
  • The website is provided for ordering from us; we're not responsible for business losses, as our service is for domestic and private use.

7. Changes and governing law

  • We may update these terms from time to time; the version shown when you place your order applies to that order.
  • These terms are governed by the law of England and Wales, and you can bring proceedings in the courts of England and Wales (or your home nation within the UK).
